Terms and Conditions

Welcome to Chakuero ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of chakuero.net (the "Site") and any services, features, or content provided through it (collectively, the "Services"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Acceptance of Terms and Age Requirement
The Services produce adult content and are intended solely for adults. By using the Site you confirm that:
- You are at least 18 years of age, and at least the age of majority in your jurisdiction if that age is higher.
- You have the legal capacity to enter into this agreement.
- Access to adult material is lawful where you are located.
We may terminate access immediately where we believe this requirement is not met.
2. Use of the Services
2.1 Access Without an Account
You may generate an image and view the free thumbnail preview without creating an account. An account and credits are required to download or save full-resolution images and to keep a persistent library of your results. Guest use remains fully subject to these Terms.
2.2 Account Registration
Where you create an account, you agree to:
- Provide accurate, current, and complete information.
- Keep your credentials confidential and not share your account.
- Notify us promptly of any unauthorized use of your account.
You are responsible for all activity that occurs under your account.
2.3 Prohibited Uses
You may use the Services only for lawful purposes. You agree not to:
- Upload or process any image depicting a person under 18 years of age, or any image that could be mistaken for one.
- Upload or process an image of a real, identifiable person without that person's informed consent.
- Create, distribute, or threaten to distribute intimate or sexualized imagery of any person for the purpose of harassment, coercion, defamation, extortion, or revenge.
- Use the Services in violation of any law, including laws governing obscenity, privacy, image rights, defamation, or intellectual property.
- Resell, redistribute, or publish generated content in any manner that misrepresents it as an authentic photograph of a real event or person.
- Circumvent rate limits, credit accounting, or access controls; scrape the Site; or attempt to reverse-engineer, disrupt, or gain unauthorized access to any part of the Services.
- Use automated means to submit generations except through an interface we expressly provide for that purpose.
Violation of section 2.3 may result in immediate termination without refund and, where warranted, referral to law enforcement.
3. User Content and AI-Generated Output
3.1 Your Uploads
You retain ownership of the images you upload ("User Content"). By uploading, you grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, and transmit that User Content solely to operate the Services for you. This license ends when the content is deleted, except for copies retained as described in our Privacy Policy.
3.2 Your Representations
You represent and warrant that, for every image you upload:
- You hold all necessary rights, permissions, and consents.
- Every person depicted is an adult and has consented to this use.
- The upload and the resulting output do not violate any law or third-party right.
You are solely responsible for your User Content and for how you use any output.
3.3 Generated Output
Images produced by the Services are synthetic works generated by an AI model. They do not depict real events and must not be presented as authentic photographs. Subject to your compliance with these Terms and payment of any applicable credits, you may use the output you generate for lawful personal purposes. We make no representation that output is free of similarity to existing works or persons, and we do not warrant that output is protectable by copyright in your jurisdiction.
3.4 Moderation
We may review, refuse, restrict, or remove any User Content or output, and suspend any account, at our sole discretion, where we believe these Terms have been breached.
4. Credits, Payments, and Refunds
4.1 Credits
Generation consumes credits. Credit prices and the credit cost of each generation are shown on the Site and may change at any time for future purchases.
4.2 Payment Processing
Payments are handled by third-party payment providers. You agree to supply accurate billing information and authorize the applicable charge. Your payment is also subject to the provider's own terms.
4.3 Refunds
Credits are delivered digitally and are consumed immediately on use. Except where a refund is required by applicable law, purchases are final and credits are non-refundable, including credits consumed on a generation whose result you did not like. Credits have no cash value and are not transferable between accounts.
4.4 Failed Generations
If a generation fails for a technical reason on our side, contact support@chakuero.net and we will restore the credits consumed by that generation.
5. Intellectual Property
All content on the Site other than User Content and generated output — including text, graphics, software, interfaces, and designs — is owned by or licensed to us and protected by intellectual property laws. "Chakuero" and associated logos are our marks. You may not copy, modify, distribute, or create derivative works from them without prior written consent.
6. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, that generation times will be met, or that any output will meet your expectations.
7. Limitation of Liability
To the fullest extent permitted by law, we and our affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Services, even if advised of the possibility of such damages. Our aggregate liability for any claim will not exceed the greater of the amount you paid us in the twelve months preceding the claim, or USD 50.
8. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your User Content, your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
9. Termination
We may suspend or terminate your access at our sole discretion, with or without notice, including for breach of these Terms. On termination your right to use the Services ceases immediately. Unused credits are forfeited where termination follows a breach of section 2.3.
10. Compliance with 18 U.S.C. § 2257
To the extent the Site involves sexually explicit content, we comply with 18 U.S.C. § 2257 and its associated regulations. Output generated by the Services is computer-generated and does not depict actual human beings engaged in actual conduct. Every person appearing in any image uploaded to the Site must have been at least 18 years of age at the time the image was created. You agree that your User Content complies with 18 U.S.C. § 2257, and you are solely responsible for maintaining and producing any required records on request.
11. Reporting Abuse
If you believe content on this Site depicts you without your consent, depicts a minor, or otherwise violates these Terms, contact us immediately at support@chakuero.net. We review such reports as a priority and will remove violating content and terminate the responsible account.
12. Governing Law and Disputes
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws rules, and without depriving you of the protection of mandatory consumer laws in your country of residence. You agree to contact us first to attempt to resolve any dispute informally.
13. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised "Last Updated" date. Continuing to use the Site after changes take effect constitutes acceptance of the revised Terms.
